Welcome to LOLALanguage, the online Language School for German & English. This agreement represents a part of the contract between you and LOLALanguage and, if applicable, the fee-based subscription services therein.
By purchasing a package from LOLALanguage, you agree to accept the terms and conditions which govern access and your use of the lolalanguage.com website. These terms and conditions constitute a legally binding agreement between you and LOLALanguage for the services provided through the website. It is expected that all users of the LOLALanguage website comply with the listed terms and conditions outlined below under all circumstances.
1. Acceptance of the Terms
By accessing and using our website, including its information, features, functionality, and tools, with or without availing the LOLALanguage "service" or "services," you agree to be bound by the following Arrangement and Terms. Whether you are a "visitor" (simply browsing our website) or a "customer" (having registered with LOLALanguage), these Terms apply to you. Throughout this document, "you" or "user" refers to both visitors and customers, while "we" refers to LOLALanguage. The term "material" encompasses all class material used in your classes. In the event that you wish to become a customer, you must express your intent to other customers and/or utilize our service/services. However, prior to registration, it is essential that you carefully read and acknowledge your acceptance of LOLALanguages terms and conditions.
If, for any reason, you do not agree with any of the terms and conditions presented here, we kindly ask that you refrain from using the LOLALangauge website and/or services.
To ensure a clear understanding of your rights and obligations, we urge you to thoroughly review all the terms and conditions before proceeding to use the LOLALanguage website and/or services.
2. Changes to these Terms
LOLALanguage reserves the right to modify or update these terms and conditions at any time. Any changes will be effective immediately upon posting on the website. Your continued use of the Site following notice of the Agreement modification will be considered an acceptance of the modified terms and conditions of use. Albeit, if major implications are applied (contract-wise), you will be asked for providing your electronic signature. Your alternative upon dissatisfaction with the modified terms of use is to cancel your subscription. Moreover, LOLALanguage reserves the right to modify, suspend or discontinue the Site at any time.
3. User Responsibilities, conduct, and IPR
All users agree to utilize LOLALanguage services solely for lawful purposes and in compliance with all applicable laws and regulations. You shall not engage in any unauthorized access, use, or distribution of any content or information available on the LOLALanguage website. You agree not to engage in any activity that may disrupt or interfere with the proper functioning of the website, including but not limited to transmitting viruses, spamming, or engaging in any form of hacking or unauthorized access.
Violation of this agreement conditions by any user will result in termination of that users’ registration and will result in notifying the authorities and possibly taking legal action.
The content provided on the LOLALanguage website, including but not limited to text, graphics, logos, images, videos, and software, is the intellectual property of LOLALanguage and protected by copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content on the website without prior written permission from LOLALanguage.
All registered users self-certify that they can form legally binding contracts under their applicable regime of their country of residence.
4. Access and Interference
By registering on the LOLALanguage website, you agree to abide by the following policies:
Automated Data Gathering: You shall not utilize any robot, spider, scraper, deep link, or similar automated tools, programs, algorithms, or methods to access, acquire, copy, or monitor lolalanguage.com or any part thereof without the express written consent of LOLALanguage. Such consent will be granted or withheld at the sole discretion of LOLALanguage.
Unauthorized Navigation and Search: You shall not use or attempt to use any engine, software, tool, agent, or other device or mechanism (including, but not limited to, browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the LOLALanguage website, except for the search engines and search agents available through the service or generally available third-party web browsers (such as Microsoft Explorer).
Software Reverse-Engineering: You shall not attempt to decipher, decompile, disassemble, or reverse-engineer any software incorporated within or forming a part of lolalanguage.com and/or its services.
5. Student Registration
When registering as a student at LOLALanguage, you will be required to provide personal information; your email address; the language of your choice; your country of residence; your local currency and local time zone. By booking a package with LOLALanguage, you automatically confirm that you accept the terms and conditions of use. All language students agree to the use of their personal information following the web site privacy policy.
6. Students – Booking and Payment Policy
Upon submitting the required fee through the LOLALanguage website, the platform will promptly issue a receipt to the student for the corresponding amount of the order. It is the responsibility of LOLALanguage to ensure that students receive the appropriate receipt for their payment. Note that students are only required to make a single payment. All transactions will be conducted in the local currency (Euros).
It is strictly prohibited for students to engage in any action or attempt to evade the payment of fees in accordance with the LOLALanguage booking policy. LOLALanguage reserves the right to modify or adjust these fees at any time. The prices displayed on lolalanguage.com include all applicable fees.
Students have to finish their purchased package in a time frame of 3 months. There is the option to extend the duration of their packages by purchasing the equivalent option (1 month, 2 months, or 4 months). This means that they can easily prolong their language learning experience by selecting the appropriate extension. There is also the option to “Freeze” a course.
7. Students – Fees and Cancellation Policy
You will be required to book a package on the LOLALanguage website. Information gathered through the registration process and information related to your account will be subject to these terms as well as to our “Privacy and Security Policy.” You warrant that the information provided for the creation of a student’s account is truthful, accurate, and complete and that this information will stay truthful, accurate, and complete as long as you are registered at the LOLALanguage website.
LOLALanguage reserves the right to change the price of the actual package fees or institute new fees at any time, upon reasonable notice posted on the website and emailed to current customers.
By purchasing a study Package, you agree to be bound to the following terms:
LOLALanguage ensures that every bank/credit card/PayPal/Revolut transaction you make is 100% secure.
All language courses fees are recurring and non-refundable after your purchase. If you do not wish to continue studying with LOLALanguage, you have provide us with a written (email) notice.
An exception to the prior paragraph is our “7-day money-back guarantee”. Within seven days after the purchase of a study package, you have the right to cancel your language course and receive a full refund by providing us with a written (email) notice.
Lesson packages booked and not used within the expiration date will be canceled and will not be refunded.
In case of a cancellation: A scheduled lesson with a teacher has to be cancelled 24h hours before the actual appointment for the lesson. Otherwise, the arranged hour is going to be deducted from the purchased lesson-package, without any further announcement or refund. This is solely contigent upon the package the student have chosen.
For groups: In case one of the students cancels the lesson but the rest of the group attends it, the hour will be charged as usual and no extra private lesson will be provided for the student who missed the lesson.
Free Trial Lesson:
The free trial is available only to first-time users of LOLALanguage website.
8. Indemnification
You agree to indemnify, defend, and hold harmless the LOLALanguage platform, its affiliates, partners, and employees from any liability, claims, costs, or damages arising out of your use of the LOLALanguage website and/or your breach of this Agreement, as outlined in the terms and conditions set forth herein. You undertake not to engage in any misconduct that could result in harm or liability to the LOLALanguage platform and its affiliates, partners, and employees.
9. Language Teachers – Delivery of Language Training Services and Registration
Registered language teachers at LOLALanguage are expected to deliver high-quality language training services to all registered language students in a prompt manner. The required standard of service may be subject to change, and LOLALanguage reserves the right to implement such changes as necessary. During the registration process as a language teacher, you will be required to provide personal information.
Note 1: LOLALanguage does not assume responsibility for the quality of the Skype/Zoom/etc interface or the communication quality between users utilizing such Apps).
By purchasing a subscription or register for a Free Trial Lesson of LOLALanguage, you agree to be bound by the terms and conditions as set out in full.
10. Impart Among Users and Termination of Account
LOLALanguage maintains the following policies regarding user interactions and account termination:
Communication Monitoring: LOLALanguage reserves the right to monitor communications between users. By using any of the communication functions provided on the platform (such as Skype, Notes, G-mail), users consent to the supervision of their communications. This monitoring is in place to protect the integrity and security of lolalanguage.com, prevent user abuse, detect fraud, and ensure compliance with our fee structure.
Language Student Account Termination: Language students have the right to close their accounts at any time. However, they remain liable to LOLALanguage and any language tutor for any unpaid lesson fees incurred prior to account closure.
11. Applied Laws, Regulations, and Jurisdiction
These terms and conditions shall be regulated in all respects by the laws of Austria without affecting any principle that may require the application of the law of another jurisdiction. The arrangements of this agreement are severable and you agree that any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Austria. Consequently, you herewith submit to the personal jurisdiction of the courts located in Austria for prosecuting or litigating such disputes or claims. Any cause of action you may have in regards to LOLALanguage must be commenced within one month after it arises, or the cause of action is repudiated.
12. Miscellaneous
In the event that any portion of this Agreement is deemed unlawful, void, or unenforceable by an arbitrator or a court of competent jurisdiction, it shall not render the Agreement as a whole unlawful, void, or unenforceable. Only the specific portion of the Agreement that is deemed unlawful, void, or unenforceable shall be removed. You acknowledge that if LOLALanguage chooses not to exercise or enforce any legal right or remedy stated in the Agreement (or any right or remedy afforded by applicable law), it shall not be considered a formal waiver of LOLALanguage rights, and such rights or remedies will remain available to LOLALanguage.
All covenants, agreements, representations, and warranties made in this Agreement shall continue to be valid and effective following your acceptance of this Agreement and the termination thereof.
This Agreement represents the entire understanding and agreement between the recipient and LOLALanguage and supersedes and replaces all oral or written agreements concerning the subject matter hereof.
